Terms for tailored private-chef services by Mery Rose Mery – Tailor Made Gastronomy.

1. Booking, proposal & payment

1.1 Proposal validity — 48 hours

Proposals are normally valid for 48 hours unless they state a different period. Website information and calculator results are indicative; the personalised proposal sets out the definitive service, date, hours, price and applicable conditions.

1.2 Booking priority — First paid, first confirmed

Availability is not held by a quotation alone. Where incompatible enquiries exist, priority is given to the booking whose required payment is received first and subsequently confirmed by Mery Rose Mery.

1.3 Advance payment

The required amount shown in the proposal is payable 100% in advance to confirm the booking, unless the individual proposal expressly states a different payment schedule.

1.4 Booking confirmation process

The process is proposal, client acceptance, required payment, effective receipt of funds and written confirmation by Mery Rose Mery. A transfer receipt does not necessarily replace effective receipt of funds.

1.5 Booking & invoicing information

The client receives the price, service, date, hours, payment, cancellation and specific conditions before confirmation. Necessary booking or invoicing details may be requested afterwards; a passport or identity-document copy is not required as a general rule or at the initial enquiry stage.

1.6 Outstanding payments & exceptional payment flexibility

Exceptionally permitted later payment or instalments do not make a booking provisional, create free cancellation or remove the financial obligations stated in the accepted proposal.

2. Cancellations, refunds & rescheduling

2.1 Strict cancellation policy

Cancellation terms are STRICT because a confirmed booking blocks availability and may require declining other requests. Payments are not automatically refundable.

2.2 Standard 4-hour Single Service — more than 60 days

Only for one standard 4-hour single service, and only where the proposal expressly provides it, cancellation more than 60 calendar days before service may have a maximum refund of up to 50% of service fees. This is not automatic, guaranteed or a general entitlement.

2.3 Cancellations 60 days or less

At 60 days or less, service fees are non-refundable unless Mery Rose Mery expressly grants an exception in writing.

2.4 Services over 4 hours & multiple services

The 50% rule does not automatically apply to Half-Day, Full Day, Full-Time Villa Chef, extended, multi-service, multi-day or consecutive services. These may be non-refundable from confirmation where the proposal states so.

2.5 Rescheduling & replacement dates

A new date is generally a new independent booking with its own proposal and payment. It does not automatically cancel, credit or transfer the original booking; any exceptional transfer must be confirmed in writing.

2.6 Written exceptions

Any refund, credit, exception or variation is valid only when expressly confirmed in writing by Mery Rose Mery and does not create a precedent.

3. Service timing, delays & operational hours

3.1 One client at a time & contracted hours

One client at a time. No overlapping services. The booked service hours are reserved for the client, not 24 hours of a date. Normally one service is provided per day, although exceptionally two non-overlapping services may be possible in different time slots.

3.2 Guest numbers & service changes

Changes in guest numbers or service scope remain subject to availability and may affect menu, quantities, staff, fees, rentals and timings.

3.3 Event timing information

Before booking, please share speeches, shows, live music, activities, children eating earlier, staggered arrivals, ceremonies, cake, photography, long aperitifs and any other timing factor affecting preparation or service.

3.4 Uncertain timings & extended service recommendation

Where timing is uncertain, reserve an extended service, Half-Day or Full Day from the outset for the required flexibility.

3.5 Client/event delays

Client, guest, activity, transport or villa delays do not pause or automatically move booked hours and can affect preparation, serving sequence and completion time.

3.6 Overtime & additional hours

Overtime requires Mery Rose Mery’s express consent, operational availability and the applicable fee. Additional time is never automatic or guaranteed, especially where another commitment follows.

3.7 Additional-hour fees

Any additional-hour fee is the fee stated in the proposal or calculator for the relevant team member and service requirements.

3.8 Time lost due to client or villa circumstances

Waiting time, unavailable access, insufficient preparation of the villa or other client/property circumstances may reduce usable service time or be treated as additional time where the proposal allows.

4. Villa, kitchen, equipment & property responsibilities

4.1 Villa facilities & available materials

Mery Rose Mery works with the villa’s available kitchen, oven, hobs, refrigeration, dishwasher, BBQ, cookware, tableware, glassware, cutlery, linen and furniture. General equipment is not normally supplied unless agreed in the proposal.

4.2 Information required before the service

Photos, video or access for the kitchen, dining areas, equipment, refrigeration, oven, hobs, BBQ, dishwasher and access may be requested. The client is responsible for reasonably accurate information.

4.3 Insufficient facilities or equipment

Where facilities are insufficient, the service may be reasonably adapted, including menu or presentation changes, simplification, rentals or external equipment. This is not automatically a breach where it results from incomplete property information.

4.4 Table setting

Table setting uses the villa’s available materials. It does not mean Mery Rose Mery supplies tableware, glassware, cutlery, linen or furniture; rentals require acceptance.

4.5 Furniture & delicate property items

The team does not move furniture or delicate items. Any required movement must be carried out by the client, villa staff or an authorised person under the client’s responsibility.

4.6 Breakages & normal wear and tear

Known evident breakage or damage will be communicated. Normal wear from reasonable use is distinct from pre-existing wear, defects, age or already damaged material.

4.7 Property access & permissions

The client guarantees access, permissions, timings and villa rules, including restrictions relating to BBQ/fire, noise, parking, loading, staff, outdoor areas or equipment.

4.8 Outdoor services & weather

A reasonable indoor alternative must be available where necessary. Service may be adapted for safety or weather conditions.

5. Food, menus, allergies & safety

5.1 Food arrangements for Single Services

For a Single Service, Food & Beverage is treated as stated in the proposal or documented purchase tickets. A separate shopping deposit is not created as a general rule.

5.2 Shopping deposits for multi-service / extended stays

For multi-service, multi-day, Full-Time, long-stay, pre-stock, pantry or complex shopping arrangements, a shopping deposit may be expressly agreed separately from service fees.

5.3 Shopping deposit deadlines — 7 / 14 days

Where agreed, a shopping deposit is normally due at least 7 days before service or arrival, or up to 14 days for complex services when the proposal requires it.

5.4 Menu finalisation — 7 / 14 days

Menus are normally confirmed at least 7 days before service, or up to 14 days for complex services. Later changes remain subject to availability and may create costs.

5.5 Allergies & dietary requirements

Allergies, intolerances and dietary requirements must be provided before menu confirmation. Services are prepared in a private villa kitchen whose prior history, utensils and potential traces are not permanently under Mery Rose Mery’s control; severe allergies must be discussed before confirmation.

5.6 Kitchen & service safety

For safety around fire, knives, oil, gas, hot surfaces and equipment, access by guests, children or animals to the kitchen work area may be limited while work is taking place.

6. Staff, partners & external suppliers

6.1 Mery Rose Mery service fees & additional staff

Chefs, waiters, cleaning, assistants, support staff and other personnel supplied by Mery Rose Mery are service fees and follow the applicable proposal’s payment, confirmation, cancellation and rescheduling terms.

6.2 Unavailability of one principal chef & replacement

If one principal chef cannot attend for justified reasons, Mery Rose Mery may use a qualified replacement. If one principal chef remains present and the agreed format, duration and level are reasonably maintained, this is not by itself a cancellation or entitlement to refund, reduction or compensation.

6.3 Unavailability of both principal chefs

If neither principal chef can provide the service and Mery Rose Mery cannot perform it, the client may choose a mutually agreed new date subject to availability or a refund of amounts paid to Mery Rose Mery for the unprovided service. Third-party costs are not automatically included.

6.4 Independent external suppliers

Rentals, flowers, decoration, transport, entertainment and specialised equipment may be external services. Where the client contracts directly, the contract is between client and supplier; practical coordination does not make Mery Rose Mery the contractual provider.

6.5 Partner, Concierge & Agency Bookings

Mery Rose Mery may work with professional partners who genuinely introduce or manage a booking. Where applicable, a mediation and coordination commission of up to 10% may be agreed exclusively on Mery Rose Mery service fees.

No intermediation, no commission. The applicable commission must be agreed before the service and does not extend to food, rentals, independent suppliers or third-party services.

6.6 Partnership Terms for Partners, Concierges & Agencies

Mery Rose Mery applies a clear and consistent partnership policy to villas, luxury concierge services, agencies, property managers and other professional intermediaries. Where a booking is genuinely introduced or managed through an intermediary, a mediation and coordination commission of up to 10% exclusively on Mery Rose Mery service fees may apply. The percentage or amount must be determined, communicated and agreed before the service takes place. No intermediation, no commission. Without prior agreement on the commission, no commission is payable.

No commission is offered or calculated on food, beverages, purchases, rentals, independent suppliers, third-party services or any other costs outside Mery Rose Mery service fees, even where Mery Rose Mery has assisted in coordination. During the same stay or engagement, commission may continue only on additional Mery Rose Mery service fees genuinely managed through the same intermediary. Intermediation is not indefinitely recurring: a future direct booking without the intermediary's involvement creates no commission.

Commission becomes payable only once the intermediated service has actually been performed and a valid invoice is received. The commission invoice must be received within a maximum of 15 days following completion of the service and, in all cases, before the end of the fiscal quarter in which the service was performed, with the earlier deadline always taking precedence. Invoices outside that timeframe create no entitlement unless Mery Rose Mery expressly grants an exceptional written authorisation. No intermediation, no commission. Without prior agreement on the amount and a valid invoice received within the required timeframe, no commission is payable.

7. Special dates, express bookings & international services

7.1 Express / Last-Minute Booking — under 48 hours

Bookings accepted under 48 hours may carry an Express Management Supplement stated only in the proposal and not calculated automatically by the Marbella calculator.

7.2 Special & High-Demand Dates — 20–30%

Special or high-demand dates may carry a 20–30% supplement on service fees when disclosed in the proposal.

7.3 Special Date cancellation conditions

Where the proposal states so, Special Dates may be non-refundable from confirmation.

7.4 International Services — minimum 7 days

International services require a minimum of 7 consecutive calendar days and are not calculated by the Marbella estimator.

7.5 Travel days

The usual minimum structure is 2 travel days plus 5 Full Service Days. Travel days do not include ordinary food service unless expressly agreed.

7.6 International service fees

International service fees are from €3,000 per Full Service Day for the Mery Rose Mery duo; the definitive amount depends on guests, number of services, complexity, destination and operating requirements.

7.7 International travel costs & proposal requirements

Flights, accommodation, transfers and other reasonable travel costs are borne by the client as stated in the proposal.

8. Final contractual provisions

8.1 Minimum content of the personalised proposal

The personalised proposal identifies the client, provider, service, date, timetable, number of services, price, payment schedule, cancellation policy, rescheduling and any specific conditions.

8.2 Client acknowledgement

Express acceptance and/or payment after receiving the proposal confirms that the client has received, read and accepted the booking, payment, cancellation and rescheduling conditions applicable to that service.

8.3 Specific-date services & withdrawal information

Food and gastronomy services for a specific date or period may, where applicable, fall within the legal exception to the general distance-selling withdrawal right. This does not create a universal waiver of consumer rights.

8.4 Written communications

Changes, exceptions, new dates and relevant modifications must be confirmed in writing. Informal conversations do not automatically amend an accepted proposal.

8.6 Applicable law

These terms are governed by Spanish law. For consumers, the competent courts are those established by applicable law.
